Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Explorely mobile application or website (collectively, the "Platform"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the Platform.

These Terms constitute a legally binding agreement between you and Explorely Private Limited (CIN: U62010TS2026PTC212952), incorporated under the Companies Act, 2013, India.

2. Eligibility

You must be at least 13 years of age to use Explorely. By using the Platform, you represent that you meet this requirement. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

Registration

To access most features of Explorely, you must create an account. You agree to provide accurate and complete information during registration and to keep your account details up to date.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at adrien@explorely.app if you suspect any unauthorised access to your account.

One Account Per Person

You may maintain only one Explorely account. Creating multiple accounts to gain unfair advantages on the leaderboard or in rewards is strictly prohibited.

4. Acceptable Use

You agree to use Explorely only for lawful purposes and in accordance with these Terms. You must not:

• Falsify GPS location data or use spoofing tools to cheat on quests or leaderboards.
• Create automated bots or scripts to interact with the Platform.
• Harass, abuse, or harm other users of the community.
• Upload or share content that is illegal, defamatory, obscene, or infringes third-party rights.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use the Platform for any commercial purpose without prior written consent from Explorely.

Violation of these rules may result in immediate suspension or permanent termination of your account.

5. Quests & XP

Quest Completion

Quests must be completed legitimately, in person, at the designated location. Any attempt to bypass location verification or fake quest completion is a violation of these Terms.

XP & Leaderboards

XP (experience points) are awarded for completing quests. Leaderboard rankings are calculated based on verified XP earned. Explorely reserves the right to remove or adjust XP earned through fraudulent means.

No Cash Value

XP points, leaderboard positions, and any in-app rewards have no cash value and cannot be exchanged for money. Explorely may modify, discontinue, or reset the rewards programme at any time.

6. User Content

You retain ownership of any content you submit to Explorely (e.g. profile photos, review text). By submitting content, you grant Explorely a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and distribute that content in connection with operating and promoting the Platform.

You are solely responsible for the content you submit and represent that it does not violate any third-party rights or applicable laws.

7. Intellectual Property

All content on the Platform — including but not limited to the Explorely name, logo, app design, quest content, and software — is the property of Explorely Private Limited or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without our prior written consent.

8. Third-Party Services

The Platform may contain links to or integrations with third-party services (e.g. map providers, app stores). Explorely is not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Explorely does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. Your use of the Platform is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Explorely Private Limited and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your access to or use of (or inability to use) the Platform.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you have paid to Explorely in the twelve months preceding the claim (or ₹1,000 if no payment has been made).

11. Termination

You may terminate your account at any time by contacting us at adrien@explorely.app. Explorely reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

Before initiating any legal proceedings, we encourage you to contact us at adrien@explorely.app to resolve disputes informally.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 7 days before they take effect. Continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
